HARARE – The trial for land developer Georgios Katsimberis failed to kickstart after he raised a red flag on why he was being prosecuted for the same charge he reported and is a chief witness.
Katsimberis is accused of fraud for constructing a show house without City of Harare approved building plans. However, Katsimberis says he used valid and legit building plans. Also, he had already levelled fraud charges against his erstwhile partners Ken Sharpe and Pokugara Properties team first for accepting his payments only to wriggle out of their business joint venture agreement.
Harare lawyer, Mr Tendai Biti who is representing Georgios Katsimberis argued that his client must not be the accused person while he is the chief witness in other matters before the Courts which involves the same charges.
Mr Biti told Harare magistrate, Sandra Mupindu that Ken Sharpe is evading justice, is a fugitive from law and serious Land baron.
“My lady the accused is a land developer, sometime in 2016 he formed a joint venture company with the complainant who is a fugitive from justice, at large and land baron, Kenneth Raydon Sharpe , Pokugara Properties managing director John Michael Van Blerk and Simbarashe Kadye have brought up charges to my client who is also the chief witness hence there are similar cases for them before the Courts,” said Biti.
Biti told the court that they had made an application for the matter to be referred to the Constitutional Court and he tendered a copy of his application to magistrate Mrs Sandra Mupindu for the matter to be referred to the Constitutional Court.
The matter was postponed to the 6th of May 2021.
